High Court Judge Weldon Korir on Wednesday allowed the Director of Public Prosecutions Noordin Haji to be enjoined in the case where the Deputy Chief Justice Philomena Mwilu is challenging disciplinary proceedings against her.
The judge also directed the DPP to file his response in the case in seven days.
DCJ Mwilu rushed to court to stop the Judicial Service Commission from proceeding with the disciplinary hearing against her on grounds that two of the JSC members are are biased.
She is also a member of the JSC.
Haji argued that Mwilu was employing tactics to delay the criminal case against her.
She been charged with fraud, bribery, abuse of office and related charges by the DPP but she has denied all the charges.
