Anne Waiguru’s Sh80 Million Kitisuru Mansion Set for Auction

Kirinyaga Governor Anne Waiguru’s Kitisuru mansion is set to be auctioned to recover rent arrears owed to developers of Kihingo Village. 

This comes after the High Court gave the developers—Frame Consultants—a greenlight to auction the Sh80 million house over the debt amounting to Sh4.5 million.

Former Tetu MP James Gethenji and his brother Gitahi Gethenji, who are the directors of Kihingo Village, owe Frame Consultants the amount.

Justice Alfred Mabeya ruled that Kihingo Village is still the rightful owner of the property since Waiguru was yet to complete payment for the house, thus Frame Consultants can auction or attach the mansion.

“In this regard, Frame Consultants can either attach or auction the property to recover its debt,” Justice Mabeya ruled.

Last year, Waiguru moved to court to block Kihingo village from evicting her from the property over Sh44 million rent dispute. Waiguru insisted that she is the owner of the property and not a tenant.

The governor told the court that she paid Sh40 million in cash for the property in September 2015 and had an agreement with KCB Bank to clear the remaining Sh40 million through a mortgage. 

Kihingo Village however denies receiving any payment from Governor Waiguru, threatening to evict her if she failed to pay rent for the five years she has stayed in the house. 

Kihingo Village had served Waiguru with a notice requiring her to vacate the property by February 29th, 2020.

Waiguru accused the company of delaying the KCB mortgage deal by failing to deliver completion documents.

“The delay in completion of the said agreement has been occasioned by the respondents who have failed to deliver the completion documents to enable the bank to register a charge against it before releasing the balance of the purchase price,” said Waiguru in court documents.

“… I am not a tenant in the suit property but a purchaser who has so far paid half the purchase price in line with the provisions of the lease agreement dated 25th September 2015.”

High Court Justice Elijah Obaga issued temporary orders stopping Kihingo Village from evicting Waiguru and directed the parties to settle the dispute through an out-of-court agreement.
