Attack on freedom of expression as organ trafficking hospital seeks to gag blogger Robert Alai

Mediheal Hospital and Fertility Centre Limited has been granted its prayers by the High Court stopping blogger Robert Alai from publishing exposes about the hospital’s involvement in underground trafficking in organs and body parts.

Justice Msagha Mbogholi granted the order certifying the case as urgent and directed that Alai be served with the papers ahead of the hearing of the case on April 22.

This is not the first time the medical facility is linked to the harvesting and ell of organs for profit. Many accounts including from current and former staff allege that that it happens in the Kesses MP Swarup Mishra owned hospital.

“This man has the highest number of title deeds, car log books and other documents. He grabs properties and sell them without the knowledge of owners who desperately want to get medical attention. The continued existence of Mishra in Kenya is a national security issue. Immigration is doing us wrong to refuse to deport this organ trafficker. If your dead relative is taken to PNN Morgue behind Mediheal Hospital, know that the liver and lungs are plucked by Mishra and taken to India. Government is silent on this but knows what this crook is doing. Exhume your loved ones. This man is harvesting organs from Kenyans”, a Eldoret town resident with knowledge of the matter wrote.

The issues raised by Alai are of public interest and not hate speech, propaganda or incitement to violence, therefore Swarup Mishra, a man of great influence in the public, is using his position aided by the court to stifle freedom of expression.

In Kenya’s constitution, freedom of expression is enshrined in Article 33 and includes the right to seek, receive, or impart information and ideas.

The hospital, according to court documents has three witnesses. They also appear coached by Swarup Mishra.

Evidence

A few years back, Mediheal hired a known human organ trafficker by the name of Dr. Prem Kumar Gokul as its top executives.

Dr Prm Kumar was among those wanted by Interpol for the same crime.

Kenya has been mentioned in Human trafficking circles; it is also a conduit for organised crimes in illegal drugs and small arms and weapons smuggling.

It is against this backdrop that people like Swarup can’t easily shake the tag of organ trafficking.

According to research, Kidneys are the most trafficked organ.

Organ trafficking, a lucrative global illicit trade, is often a lesser discussed form of human trafficking among anti-human trafficking stakeholders due to its intricate and often stealth nature.
