Gatundu South Member of Parliament Kuria is not yet off the hook after Director of Public Prosecutions (DPP) Noordin Haji requested the court to allow him introduce a new evidence.
On Wednesday, through a representation of his assistant, Kennedy Panyako, DPP Haji said that the previously lost witness files has been found and they are ready to use it.
“Their evidence is crucial to this court. We are seeking the court to compel them to come and give evidence,” said Panyako.
Magistrate Kennedy Cheruiyot was told that the lost evidence was found at the National Cohesion and Integration Commission offices after a mistake in filing.
Hence, DPP Haji felt the need of introducing the new evidence after the eight witnesses backed out from testifying in the case.
However, through lawyer Geoffrey Omenke, MP objected Haji’s request saying that it would prejudice him.
To date, only four witnesses have testified against Kuria’s hate speech on June 26, 2015, that was intended to cause physical harm.
The DPP was ordered to find out who stole the file carrying the evident towards the case last December.
Kuria has however accused Director of Criminal Investigations George Kinoti for interfering with the case.
In the meantime, Kuria is also facing assault charges after he reportedly harassed a woman at the Royal Media Services (RMS).
