Confusion has rocked Nyandarua county assembly after Nakuru High Court reaffirmed its earlier decision to have speaker Wahome Ndegwa reinstated. Justice Hillary Chemitei, in his ruling gave temporary injunction. Staying on grounds, the assembly flouted the impeachment process. He directed status quo be maintained until the matter is determined.
“The court hereby issues a temporary injunction and stay of the execution of the assembly decision to impeach the applicant pending hearing and determination of the suit,” he read It has emerged in the ruling the assembly did not meet the 75pc threshold of impeachment. Only 26 members voted for the motion thus less than the required percentage that is 75pc. The 26 accounted for only 70pc. Eleven MCAs were against the impeachment motion thus getting 29 pc of the total votes.
