Barely 2 weeks since we ran an article bringing to light the abuse of prosecutorial privilege by influential members of society through the ODPP to eliminate their competitors, DPP has moved swiftly to get to the bottom of this scheme and ordered his officers to look into the matter afresh.

The article EXPOSED: DPP AND DCI DRAWN INTO ASSASSINATION PLOT was the sordid story of how the daughter to former Cabinet Minister and KANU Sec. Gen JJ Kamotho was attempting to use DCI and DPP to eliminate people who have sued her at the Environment and Land Court over the ownership of land in the town of Thika.
Maryanne Nyokabi Kamotho, an aging Nairobi socialite, has been tussling over the ownership of this property with a Thika family for close to 12 years, and now looks set to have her day in the civil court to explain how she acquired registration and ownership documents to the property.
Cognizant of the fact that her own evidence does not meet the threshold to sustain itself against the brutal scrutiny of a High Court, she has used the malleable Directorate of Criminal Investigations (DCI) and members of the dreaded Lands (Ardhi House) cartels to manufacture evidence in an attempt to lampoon the Thika family with a criminal prosecution.
In a classic case of the left hand being completely oblivious of what the right hand is doing, DPP has ordered his officers in Thika o get to the bottom of the matter.
They are the very same officers who are blissfully unaware of the fact that this criminal prosecution has been ongoing for close to 8 years, and within that time, that it has been thrown out by the trial court after an initial 5-and-a-half years without them presenting a single witness.
How then was DCI convinced to re-engineer the charges and present them to ODPP who approved a fresh prosecution over the ownership of the same property and whose ownership is the subject of civil litigation?
Does DCI apparently have better knowledge than the High Court about who really owns this property?
2 weeks ago at Thika Law courts when the family members presented themselves to take plea in a reincarnation of their old trial, the confusion on the face of the State Counsel was comical when he learnt that the matter he was presenting in court had morphed over 7-and-a-half years and that he had been duped into believing that this was the first time the matter was coming up for trial.
Strangely, DPP has asked the family members to lodge complaints with DCI at their headquarters on Kiambu Road the same place that they met Executive Advisor to Director of Criminal investigation, a Mr. Mohammed Roba, who turned them away and sent them to the same Thika DCIO that they were running away from.
As vindication to our exposé on the character and borderline psychotic state of Maryanne Nyokabi Kamotho and her entitlement to wealth, the East African Standard carried a story last week of a court battle that she has brought against her own mother and brothers over the distribution of her father’s property.
In the suit, Nyokabi seeks to block her own mother from becoming the administrator of her husband’s (JJ Kamotho) estate in a suit that defies all logic, especially because the late KANU hawk died without a will.
The thunder waiting to clap this woman and anyone in her vicinity is likely doing stretches now!
It would be best for people to steer clear of her.
