Court of Appeal has upheld the decision to sentence to death former Ruaraka OCS Nahashon Mutua who was found guilty of killing a suspect in police cells.
Mutua lost his bid to dodge the hangman’s noose after three appellate judges found that the death sentence by the High Court is legal pointing on impunity and the manner in which the suspect, Martin Koome was killed.
Appellate Judges Hannah Okwengu, Mohhamed Warsame and Agnes Murgor hit the last nail on Mutua’s fate for clobbering Koome inside a police cell on October 19, 2003.
Koome passed while waiting to be treated at the Kenyatta National Hospital (KNH) after the ruthless beating.
The deceased sustained serious in police cells but the OCS had instead implicated one Mr Kevin Odhiambo who shared the cell with the late Koome on the fateful day.
Odhiambo was set free by the trial court after the Office Director of Public Prosecutions entered nolle prosequi in the criminal case that could have forced him to pay for an offence he never committed.
The late Koome was accused of attempting to strangle his wife and child after a domestic brawl in Baba Dogo Estate on October 19,2013. His neighbours alerted by the fights called in police officers from Ruaraka Police Station who arrested him.
