Is there a provision, law or even a court order that allows the police to arrest a brother or a sister to, rather on behalf of a suspect?
A Kenyan has reach to this site with this sad story detailing how his ailing brother was arrested on behalf of his other brother at large.
Yes, we should be our brothers keepers but that isn’t the ground to abuse the law.
Here is the complaint from a concerned Kenyan.
Dear Kenyan Bulletin
I have been following your stories and i like what the site is doing in both informing and helping the people. Thank you for that.Today morning, my brother was arrested on behalf of my other brother.
My bro Calistus Sang together with his friends in Nairobi came together and took motorcycle on loan.
Sang who was the custodian of the motorcycle got involved in an accident and has not been able to pay the weekly dues. He is still in plaster with a fractured leg.
My other brother Peter who was left in charge of Calistus’s house was arrested this morning and the police are asking him to produce Sang.
When Sang took the motorcycle on loan, my brother Newton did not participate in the signings of the loan. He was neither a signitory as the loan owner nor a guarantor.
Infact, the person who signed for the loan is roaming free yet police are holding my younger brother who is a watchman.
Can you help me air out this issue of my brother as i call out officers in Riruta police station, Kawangware?
I have no idea nor ever heard of an event where the Police have had a right to arrest a person on the behalf of another just because they’re blood relatives.
Please help us to tell the police that I cannot be arrested and prosecuted because of the mistake of my brother, sister or my parents. Thank you once again.
Have you ever been arrested on behalf of your relative? Let us know your story in the comments space below.
