Kijabe Hospital has been ordered to compensate a widow whose husband died after doctors at the facility removed part of his brain during a tumour operation with Sh6 million.
Justice Lucy Njuguna ordered the hospital to compensate the family of the late Michael Mwangi for medical negligence.
“The deceased was the breadwinner for the family and as a result of his death, the dependents have lost the support that they used to get from him. The court finds that the hospitals breached the duty of care owed to the deceased and must compensate his family,” Justice Njuguna ruled.
The case against the hospital and quack surgeon Leland Albright was filed by the widow of the deceased, Monica Wairimu.
She also accused the AIC owned hospital of subjecting her husband to serious pain and damages before he died.
Wairimu took her husband to Kijabe Hospital in October 2012 after he complained of severe headache but upon medical examination, quacks discovered that he had brain tumour which required surgery to remove.
After raising the needed fee, her husband was then admitted on December 16, 2012 and the operation done on December 27, 2012.
But her husband was moved to the Intensive Care Unit (ICU) until January 16, 2013 when he was transferred to the general ward and died a week later.
The widow also told the court that after the death of her husband, an independent pathologist conducted an autopsy that revealed that his brain had been removed instead of the tumour.
The pathologist in his report concluded that had the doctors not removed the brain, Mr Mwangi would not have died.
