ODPP VS DCI: War escalate as Noordin Haji Staff Warned

The war between the Office of The Director of Public Prosecution (ODPP) and Directorate of Criminal Investigations (DCI) has escalated.

In a communication seen by Kenyanbulletin.com, the staff at the DPP office have been strictly instructed to forward all cases to Inspector General of Police (IGP) and not DCI.

“Morning, once again. These are the detectives of the DPP. First, strict compliance with the Constitution of Kenya, 2010. Secondly, directions from The DPP will only be to IG and not DCI. In the Counties to County Police Commander, OCPD, OCS in that order. Thirdly, no single communication to the DCI. Fourthly, we are being haunted by DCI on issues of integrity. Any staff member acting in wayward manner to suffer consequences of his actions. And finally, no idle talk, chats and comments”, the message forwarded to Kenyanbulletin.com read.

The war between Haji and Kinoti

It all started in March 2020 after the secret arrests of Kenya Ports Authority (KPA) MD Dr Daniel Manduku alongside Kenya Revenue Authority (KRA) Commissioner for Customs and Border Control Kevin Safari over accusations of conniving to gazette Nairobi Inland Cargo Terminal/Depot (ICD) as a KPA peripheral facility between March 21 and June 14 last year. This was allegedly done despite the fact the facility did not meet the requirements for gazettement.

Safari and Manduku were also accused that between December 31, 2019 and January 27, 2020 they conspired to defeat justice by influencing payment of Sh3.1 million for KPA peripheral facility licence for a company. This was allegedly done to correct an illegality of none payment of the same that was already under investigations.

When the case was taken to court, the two were released after the magistrate said no charge has been preferred against the duo. It later turned out that the file of the duo who were arrested secretly was recalled by the ODPP. (Sadly, the two Safari and Manduku have since been fired and resigned respectively from their offices)

That time DCI Boss Kinoti and DPP Haji said there was no bad blood between them. But less than two months later, even if two days ago shows otherwise.

On Monday, the arrest of National Water Harvesting and Storage Authority acting chief executive officer Eng Geoffrey Sang by DCI was not taken lightly by DPP.

Mr Sang was taken to court but his file was missing, the same thing that happened in Manduku and Safari case.

The DPP refused to approve the prosecution of Mr Sang.

The National Water Harvesting and Storage Authority CEO was being charged with a number of counts including abuse of office, conspiracy to defeat execution of a written law, neglect of official duty and breach of trust by persons employed in the public service.
