Struggling Ford Kenya leader Moses Wetangula has suffered a serious blow after the Political Parties Dispute Tribunal stopped him from kicking out turncoats who plotted his ouster.
Bungoma senator has received the bad news weeks after convening a National Executive Council meeting which expelled Tongaren MP Eseli Simiyu, Kanduyi MP Wafula Wamunyinyi and Busia nominated MCA Cynthia Mutere.
The NEC’s August 17 meeting resolved that the General Council effects the changes and warned party members and supporters from conducting any business with the three.
But the tribunal has stopped the Ford Kenya leader from kicking out the three members after it issued conservatory orders to stop the expulsion following a complaint raised by Crispinus Barasa, a Ford-k party member.
He argued that the NEC meeting Wetang’ula led was illegal since it was not convened by the secretary-general according to the party constitution.
The complainant further argued that the notice is null because the attendance of NEC meeting did not meet the required quorum. The meeting was also convened against the government’s covid-19 measures.
Barasa went on to argue that Kiminini MP Chris Wamalwa has been trying to force NEC members who did not attend the NEC to sign the attendance register, a desperate to achieve the quorum.
“Wamalwa has been making phone calls to members of the NEC who did not attend the illegal meeting and is intimidating, threatening and coercing them to sign an attendance register.” Barasa said.
Political Parties Dispute Tribunal (PPDT) chairperson Desma Nungo, in a ruling dated September 9, suspended the NEC resolution and gave the Wetang’ula team seven days to respond.
