Jubilee Party’s Secretary General Raphael Tuju and his three children have been ordered to appear in court on September 21 for disobeying a court order.
In march, the court ordered Dari Limited to allow the managers appointed by the East Africa Development Bank, Muniu Thoithi and George Weru to access the property over a Sh1.5 billion defaulted loan.
Tuju was also required to provide EADB with Dari’s statement of affairs, cash books, financial returns and company records dating to December 23, 2019 to date, the management accounts, the debtors and creditors listing and the staff payroll for the past three months.
He has not complied with the orders, and together with his children, the cabinet secretary may be committed to a civil jail for six months for failing to grant receivers an access to the property.
But Judge Mary Kasango went on to grant receiver managers permission to resume their duties in Dari as ordered by the court earlier.
Tuju is battling many suits in court including threats by EAD Bank to auction their property and declare bankruptcy.
He took a Sh1.5 billion but he has defaulted to pay back. His children acted as guarantors of the loan that was used in putting up 12 two-storey bungalows, each worth Sh100 million in a 20 acre forested land.
Part of the money also went into purchasing of a 94 year old house built which the CS is currently running as a high end hotel.
The bank’s lawyer Fred Ojiambo, told the court that the debt has been piling and may get to a point where even the securities listed may not be enough to offset it.
