Deputy Chief Justice Philomena Mwilu is appearing before the Judicial Service Commission (JSC) over a petition filed against her in a corruption case by DPP and the DCI.
She will face the JSC, chaired by the Chief Justice David Maraga at the JSC Headquarters in Nairobi.
Her defence team led by Siaya Senator James Orengo and lawyer Nelson Havi are seeking to have the session held in cameras.
The panel is set to make a determination on whether media will be be barred or allowedto cover the proceedings.
The event is spelling showdown between DCJ Mwilu and DPP Noordin Haji who is appearing before the JSC as a witness.
Mr Haji and Directorate of Criminal Investigations (DCI) boss George Kinoti are interested parties in the petition seeking Justice Mwilu’s removal from office. They will give their evidence and will also be examined by Mwilu’s lawyers.
Reliable sources reveal that JSC has decided to hear and determine all cases filed against some of the Supreme Court judges.
Haji and Kinoti appearing before JSC comes in the wake of a battle between the Judiciary and the Executive. JSC sent sent letters to all key witnesses in this case including Kinoti and Hajji.
Mwilu had alleged in the High Court that the allegations leveled against her precipitated from the Supreme Court nullifying President Uhuru Kenyatta’s election in 2017.
President Uhuru Kenyatta and Dp William Ruto while reacting to the nullification of their win in 2017 vowed to fix the judiciary (Maraga na wakora wake) if they got back to power, which thay did.
The other petitions filed touch on Chief Justice David Maraga, Justice Njoki Ndung’u and Justice Mohamed Ibrahim.
