Chief Justice Maraga to Uhuru: Swear in the judges

Former Chief Justice David Maraga has gone all out to blast President Uhuru Kenyatta for his refusal to appoint the six judges that were recommended by the judicial service commission.

On June 3, President Uhuru Kenyatta had refused to appoint High court judges that declared BBI unconstitutional citing concerns on their conducts.

The six judges include; Weldon Korir, Aggrey Muchelule, Makori Evans Kiago, Judith Omange Cheruiyot, Joel Ngugi and George Odunga, the last two judges were part of a bench that declared the Building Bridges Initiative (BBI) unconstitutional.

During a live interview with KTN News, Chief Justice Maraga confirmed that President Uhuru tempered with the list of judges “with integrity” issues by adding to the lists of those who ruled against BBI.

“I can confirm that the names have been changed, those who were said to have issues have been added to that list and others removed. If it was bonafide allegations why is this shift’’ Ex-CJ Maraga told KTN.

“The thinking in Kenyans minds is these fellows have integrity issues and when someone loses a case in front of these judges they will come up with allegations, frivolous allegations that this man was bribed and we have reported he has someone who takes bribes,” Maraga said.

Former Chief Justice Maraga has been adamant in calling out the President for totally disregarding the law in many instances including when the judiciary budget was cut causing operational crisis which hampered service delivery in the judiciary.

“With all the court orders issued, the President is adamant and saying that he will not take the easy way. The constitution has not given the intelligence the power to appoint judges, the views of the intelligence have their place,” Chief Justice Maraga said.

The former Chief Justice Maraga, urged the President to swear in the judges then afterwards lodge a complaint which is per the protocol issued in the constitution.

“There is a procedure. Swear these judges in, lodge a complaint before JSC and whoever has been appointed will be removed’’
