A Nairobi court has given the investigating officer one week to record the statements of President Uhuru Kenyatta and former Prime Minister Raila Odinga.
This is in regard to a case against mere casuals in a local hotel who have been charged with the offense of unauthorized interception of computer data contrary to section 17(1) of the Computer Misuse and Cyber Crime Act.
Uhuru and Raila have been listed as complainants in a case where two suspects, Rading Ambogo and Magoma Ayonga are accused of intercepting CCTV footage capturing the Head of State’s entourage on June 2nd at around 8 pm on Kenyatta Avenue.
“We had requested statements from the complainant who is the President of this country and Raila Odinga who were alleged to have been in the entourage, to date, those statements have not come,” the court heard.
The two accused through their lawyer have rubbished the charges against them saying they do not exist in law.
“This alleged offense of intercepting a security CCTV does not exist in law. Our clients were never in State House and have never gone to any government installation to capture CCTV footage of government,” said the lawyer.
Defense counsel who is Danstan Omari also told the court that one of the accused person is apprehensive and psychologically traumatized and fears for her safety.
The defense lawyer also requested that they are supplied with the original clip that captured the entourage on the said day.
The case will be mentioned on the 9th of July.
