Attempts by Blogger Cyprian Nyakundi to get his iPhone X from the Directorate of Criminal investigations were thwarted after the investigating officer in the case said they have been attempting to get into the iPhone all to no avail.
The phone was confiscated by the DCI after the blogger was arrested last year in a dispute with Victoria Bank, in a case where Tinta Akasha, a brother to the convicted drug barons is a witness.
The DCI officer, Mr Odhiambo indicated that they have tried to unlock the phone and get the contents but failed. Nyakundi was at the Milimani law courts today for the case’s hearing.
Mr Odhiambo also indicated that the Blogger refused to give his unlock password and asked DCI to use their means to unlock it because he is not obligated to help them do their work.
The Judge refused to order the release of the iPhone, directing that she will rule further on the matter.
In January, the Business Daily reported that US tech giant Apple rejected a request by the Kenyan government to unlock two iPhones that were the subject of police investigations in the six months to December.
The US Securities Exchange Commission (SEC) filings of December 23 indicate that Apple received an appeal from Kenya seeking communication details on an iPhone that remained locked.
It remains a mystery on whose iPhones the DCI wanted to be unlocked with a suspicion that one of them may be Nyakundi’s iPhone.
