Kakamega Woman in court to bury her son

A woman in Kakamega has moved to the court, seeking orders to bury their son with Stanley Wafula who she is accusing of being an absentee father who never supported their son.

Ruth Shikuku argues that Kakamega Chief Magistrate Bildad Ochieng relied on old customery laws in  allowing Mr Wafula to bury their son.

She wants the High Court to grant her orders to bury her son, Edward Wanzetse.

She explained to the court how a neglecting father who never provided or supported her son.

She also claimed that Wafula wanted her to terminated her pregnancy when her son was conceived 31 years ago.

Ruth also narrated to the court how she was entirely responsible for her son’s education without the help of Mr. Wafula.

In his defence, Wafula claimed that he occasionally visited Ruth and his son but  he only stopped to visit when he learnt that Ruth was at an advanced of stage of a relationship and was intending to marry her current husband David Were.

Wafula went court on September 16th to seek orders to bury Wanzetse who passed on September 4.

He argued that among his people fathers have every right to bury their sons in their ancestral lands.

He was granted the right to bury his son in Namirama, Kakamega County.
