According to Miguna, the CAS positions are unlawful hence he would not accept such an appointment. Asked whether he would accept a government appointment, Miguna said:
“It depends on which government appointment. There are things I would not take. The appointment would have to be proposed then I would say whether to take it or not. There are so many things I would not take like the illegal CAS position,” added Miguna
The Employment and Labour Relations Court in Nairobi last week granted the Law Society of Kenya (LSK) stay orders against the establishment of the Chief Administrative Secretary (CAS) position under the public service.
The court barred recruitment of the CASs until LSK’s application challenging the creation of the post is heard and determined.
The hearing date has since been set for October 24th this year.
