Property row has once again rocked President Uhuru Kenyatta’s kin after his brother in-law renewed his court battle with with his stepmother seeking to evict her from her home in Muthaiga Estate, Nairobi County.
This is after Udi Gecaga renewed his legal duel with Margaret Gecaga seeking to eject her from their Muthaiga property left behind by the Late husband Bethuel Gecaga over transfer complications.
Reports from the Court documents show that the late Bethuel Gecaga had transferred the ownership of all the eight properties in Muthaiga to his son Udi, before his death in December 2016.
Among the properties in contention is the family home in Nairobi’s Muthaiga home where Margaret lived with Bethuel before his demise, with Udi reportedly demanding an accrued rent of 9 Million since the death of his father.
In defense Margret argued that her husband had suffered memory loss due to his ill health from Alzheimer’s disease, and could not have not bequeathed that to the son knowingly.
She further question the preparation of the document by an independent advocate, faulting Udi of hatching a plot to deny her a share of the multi-billion property.
This is after the courts had awarded Udi the ownership of the 8-high-end multi billion properties, a thing later upheld by the ruling of the high court following a challenge by Margret.
In his ruling, Justice Nzioka of High court noted that she had failed table proof that the properties were co-owned or acquired at the time of their marriage with the late husband Bethuel.

“On the issue of whether Muthaiga properties were to be considered to be matrimonial property, the Tribunal made its findings. In particular, the Tribunal found at paragraph 169 that the properties were purchased in the 1960s and 1970s when the deceased was married to his late wife, Jemimah Gecaga.
“Having analysed the findings of the tribunal on the subject issue, I did not find any evidence that it violates or is contrary to public policy,” he ordered.
The two tied the knot in 2007, 28 years after the death of her co-wife Jemimah Gecaga, even though she indicated that they had been together since 1993.
