Dagoretti South MP John Kiarie has said that former IEBC vice Chair Juliana Cherera and Commissioner Justus Nyang’ya who resigned over their attempts to subvert the results of the last general elections are not off the hook.
Kiarie said the tribunal should go ahead and investigate the four troubled IEBC commissioners. He said the law is clear on how one ascends and can be removed from an independent office.
“The four commissioners are resigning because they know the facts that led us to where we are and the people behind them. The tribunal should go ahead with the inquiry even if the commissioners resign,” said Kiarie.
The tribunal was appointed after a report by Parliament recommended that the president appoints a taskforce to investigate Cherera and four colleagues.
The vice chairperson Juliana Cherera and commissioner Justus Nyang’aya chose to resign after the tribunal was appointed but Francis Wanderi and Irene Masit are still hanging on.
The suspicious Nyang’aya resigned immediately after a gazette notice informing the public on their suspension was released. He argued that his move was in the best interest of Kenya.
“It is with immense woe that today I tender my resignation as commissioner and vice chairperson of Independent Electoral and Boundaries Commission,” reads her letter.
Cherera and her three friends disowned the last general election’s results announced by IEBC Chair Wafula Chebukati that declared Ruto the presidential winner on August 15, 2022.
The nine-member tribunal that includes Carolyne Kamende Daudi, Mathew Njaramba Nyabena and Col. (Retired) Saeed Khamis, Kibet Kirui Emmanuel, and Irene Tunta Nchoe as joint secretaries will investigate them and file a report and recommendations on how they should be dealt with.
The vice chair and Nyang’aya have also resigned at the time when the opposition leader, Raila Odinga, is increasing his calls for mass action to shield four commissioner from facing the law and being kicked out of the IEBC.
