In 2014, a brief presented to Parliament by then NHIF chief executive officer, Simon ole Kirgotty, suggested that  Proprietors of Baseline Architects and Ujenzi Consultants were hired by former CEO Ibrahim Hussein without the board’s approval.

The two firms have a long history of dealings with NHIF. Ujenzi, for instance, undertook quantity survey work for the construction of the fund’s headquarters in Upper Hill. It was also involved in the construction of NHIF’s storeyed car park whose cost was inflated by 337 percent to Sh3.97 billion, according to an official audit.

Malala currently lives in Karen Plains in a house that was at one time valued at Sh60 million by the contractors. He also has a mixed development of residential and commercial property in Karen. He is also said to own substantial parcels of land in Narok by people familiar with his assets.

Land grabbing allegations

Do you remember when now Kisumu Governor Peter Anyang’ Nyong’o was Medical Services? He was identified in a report as the man behind the rooting for the contractors to be paid. The former Office of the Prime Minister also echoed Prof Nyong’o’s support for the stalled project and went further to suggest that funding for the Sh22.6 billion institution could be sourced from the Chinese government.

In a lawsuit filled in 2002, residents of Karen alleged that the sale of land in the area to NHIF for Sh93.7 million for construction of a staff recreational center that later mutated into the proposed medical centre was itself irregular. This was the same time NHIF, was dubbed “Nyong’o Homes Insurance Funds”

It is claimed that the land — measuring about 23 acres — was part of open space for residents but that it was grabbed by then senior government officials who jointly joined forces with some of the individuals forming the consortium of NHIF consultants.

In a civil case suit No. 129 of 2007, Malala was sued by his partner at Ujenzi Mathias Nasubo Ogana after Ogana demanded sh78 million as compensation after retiring from a business partnership. In court papers, NHIF was to pay Ujenzi sh 113 million part of which Ogana demanded.

According to the lady, Malala sacked her without notice and has refused to pay for her pending salary, allowances. To complicate matters, she wants a six-month salary for wrongful dismissal. Now the Luo lady says she’s fearing for her life, she accuses Malala of using his other clande from Bungoma county he has been keeping to threaten her.
