Driver now demands Sh5 million compensation after a botched robbery

A driver of a leading hardware firm in Mombasa who narrowly escaped with his life in a botched robbery attempt is now demanding Sh5million from his employer as compensation for incapacitation.

Aboud Nyenye, 26, is suing Mohammed Kassam, the proprietor of A.N Isaak Hardware Limited over the incident that occurred in 2018. Rashid Omar who worked at the firm as an accountant lost his during the incident.

Police have launched investigations into the death of the accountant as reports now emerge linking the family wrangles into the incident.

The family has written several letters to the Inspector General of Police, protesting over multiple cases over the same incident being probed.

Mr. Ngenye seriously injured his arm in the shooting incident that occured along Moi Avenue where the accountant was shot and killed.

A report filed at the Makupa Police Station through OB number 60/5/11/2018, by a close relative led to the summoning of one of the hardware managers who has also recorded statements.

The parties to the case are also pursuing ballistic report to be availed to give clear indications over how Omar met his death amid claims that he was siding with one member of the family.

Ngenye’s lawyer, Daniel Wangila said that despite being shot around the neck, below the jaw, and at the chest, the manager insisted they drive to bank to cash the money that was stashed in a sack.

Wangila is now pushing police to investigate the shooting incident as he wrote to the DPP who further directed that the file be forwarded to his office.

Ngenye had taken a medical examination which will help in assessing incapacitation, as they prepare to file a claim.

“We shall use the medical reports from the hospital, to argue our case. We need to understand why the cash was being transported without escort, endangering the workers’ lives,” Wangila said.

The DPP has ordered police officers to carry out speed and conclusive investigations into the matter after the driver turned down a Sh231,680 offer from his employer who had also paid over Sh1.2 million through insurance when he was admitted for nine days.
