The ODM party has said that it will not share Political Parties Funds with NASA Coalition affiliates based on their strength at the 2017 polls.
The outspoken ODM Secretary-general Edwin Sifuna said parties like ANC, Ford Kenya and Wiper may get something based on the presidential vote but the annulment of that election means ODM can as well avoid sharing with them.
“They cannot be entitled to monies due to ODM on account of the votes received by the party’s other candidates, that is governors, MPs and MCAs, for the simple reason that they did not campaign for them,” Sifuna said.
He argued that NASA avoided the repeat poll after the Supreme Court nullified the 2017 presidential results meaning the Registrar of Political Parties must consider the August 8, 2017 presidential results when distributing the funds.
“ODM does not, therefore, receive any money on account of presidential votes from the 2017 General Election. ODM does not, therefore, owe any monies to any other political party,” Sifuna added.
A party must have at least 20 MPs, three senators, three governors and 40 MCAs elected on its ticket. to qualify for the funds and only Jubilee and ODM qualify, going by the outcome of the 2017 General Election.
Registrar of Political Parties Anne Nderitu has give ODM all the money claiming that there was no sharing formula and other Nasa affiliates failed to complete the process,
ODMs Sifuna accused Nderitu of misleading the process arguing that the registrar only needs to consider the number of votes received by a political party in the preceding General Election when sharing funds.
“ODM has on several occasions written to the Registrar of Political Parties to argue the case that applying the presidential results of the repeat election when the law demands that she apply the results of a general election is unlawful.” Sifuna said.
He further added that the decision has resulted in a skewed allocations in favour of Jubilee Party.
He also claimed that the Raila Odinga led ODM has advised Nderitu to move to the Supreme Court for an advisory opinion but she has ignored.
Sifuna also claimed that Sh4.1 billion are arrears awarded to Raila’s party for the period between 2012-2016.
He further challenged their small coalition partners claiming monies from ODM to seek legal interpretations on political party funding and annulment of elections.
