The High Court has temporarily stymied the incumbent Cabinet Secretary Adan Mohamed from becoming the Commissioner General of the Kenya Revenue Authority (KRA).
Justice Lawrence Mugambi issued the orders in the petition filed by Benard Opere, who claimed that Mohamed had reached the retirement age for public officers.
Treasury Cabinet Secretary John Mbadi appointed Adan Mohamed through a Gazette Notice dated May 18, 2026, to replace Humphrey Wattanga.
The court ordered Mohamed not to take office until the case is heard on May 27, 2026.
The petition alleges that the appointment goes against Public Service guidelines and the principles of accountability and good governance in the Constitution.

Mohamed held the following positions: Cabinet Secretary for Industrialisation under President Uhuru Kenyatta and several senior positions in the private sector, one of which was at Safaricom.
The case has drawn attention to the question of compliance with the law concerning public appointments in Kenya.
