Court orders Keroche to pay the taxman Sh100 million

The court has ordered Keroche breweries to pay Kenya Revenue Authority (KRA) Sh 100 million to stop them from attaching its assets in a Sh 9.1 billion case.

Court of appeal Judges Patrick Kiage, William Ouko and Daniel Musinga gave the brewer 45 days to make the payment or else KRA will be free to raid its accounts.

Keroche went to the appellate court after it failed to pay a Sh500 million condition that was set by Judge David Majanja of the High Court. It argued that Majanja did not consider it’s inability to raise the said amount.

It also asked the court of appeal to render Majanja’s ruling useless if kra failed to lift the agency notices to it’s banks.

Keroche claimed that such notices would ground the firm to a complete halt.

Appellate Judges lifted the agency notices issued on Equity Bank limited and Absa Bank of Kenya  today’s ruling.

The judges considere the current covid-19 situation and challenges it has brought tot the businesses and economies world over.

“It is evident that KRA has issued agency notices to Keroche’s bankers. Unless the orders sought are granted, the agency notices shall be effected and Keroches operations will be grounded, thus rendering the appeal nugatory,” the judges said.

KRA was against Keroche’s application arguing that the earlier condition of Sh 500 million set by Justice Majanja was lenient and fair enough.

The taxman urged the court to dismiss Keroche’s application because they had been linient on them on payment of taxes.
Keroche howevwer maintained that it is unable to repay a loan it took from Absa Bank which is Sh57,000,000 every month. Any defould may lead to the Bank calling up the loan and liquidating its assets, an event which may lead to a complete collapse of the company.
