President-elect Dr. William Ruto will begin receiving briefings from top national security organs after emerging the winner of the August 9 General Elections.
Dr. Ruto will be given daily briefs by organs which include the National Intelligence Service (NIS), the Kenya Defence Forces and the National Police Service (NPS).
The Assumption of Office of the President Act of 2012 requires the public officers to provide all the necessary information to the incoming president.
As the president-elect, Dr. Ruto may carry out preparations or request in writing for such information from a public officer in his capacity as the President-elect if he deems it necessary.
The constitution also compels a public officer from whom such information is requested to provide it within a reasonable time.
“A public officer who fails to comply with the provisions of this section commits an offence and is liable, on conviction, to a fine not exceeding one million shillings or to imprisonment for a term not exceeding two years, or to both,” the law states.
The constitution stipulates that upon the declaration of the final results of a presidential election by the Independent Electoral and Boundaries Commission (IEBC) under Article 138 of the Constitution and section 39 of the Elections Act 2011, the committee shall ensure that the President-elect and Deputy President-elect are accorded adequate security.
The Act further states that the President-elect shall, in consultation with the Assumption of office of the President Committee, carry out such preparations as may be necessary for assuming office.
Dr. Ruto garnered 7,176,141 votes which represents 50.49% to beat the veteran opposition leader and former Prime Minister Raila Odinga who garnered 6,942,930 votes (48.85 percent).
If there is no petition filed by Odinga to challenge his election win at the Supreme Court of Kenya, Dr. Ruto will be sworn in on August 30.
