Telecommunication firm Safaricom Plc is accused of disobeying Environment and Lands Court order in the construction of its Staff Pension Project.
The court had suspended the construction after Mavoko Water and Sewerage Company (MAVWASCO) went to court accusing the firm of building on top of sewer lines therefore jeopardizing the liquid waste management of the area.
The case which was filed and certified as urgent on 14th July 2021, will be heard tomorrow, Tuesday 27th July 2021.
“THAT a temporary injunction be and is hereby issued restraining the Defendant either by itself, agents, servants, employees or proxies from excavation, laying foundation, construction, cementing, culverting, building structure on top of the plaintiff sewer line and using structure dealing in anyway whatsoever with the plaintiff sewer line at crystal river project along quarry and Mombasa road, ” the court had ruled.
The contractor Prestine Contractors Limited was found to be in breach of the court order as some construction was ongoing.
Mavasco had filed a petition against Safaricom Pension Trustees Project and Prestine Contractors Limited on allegations that the ongoing construction of the two are interfering with the company’s sewerage system and is likely to affects hundreds of residents in the surrounding estates.
The court further directed the Athi-river officer commanding (OCS) station to enforce the restraining order.
The court ordered both parties to appear before it tomorrow.
